A person giving personal advice to a retail client acts in the client's best interests (s 961B), satisfied by proving the steps in s 961B(2): identifying the client's objectives, financial situation and needs from their instructions and the subject matter of the advice, making reasonable inquiries where information is incomplete or inaccurate, declining where lacking expertise, reasonably investigating and assessing products where a recommendation is considered, basing all judgments on the client's relevant circumstances, and taking any other step reasonably regarded as in their best interests. The advice must be appropriate (s 961G), and where the provider knows or should know of a conflict with its own, its licensee's or associates' interests, it gives priority to the client's interests (s 961J).
