ACT Workplace Privacy Act 2011 26: s 26 Applying to the Magistrates Court for a covert surveillance authority

An employer may make a written application to the Magistrates Court for authority to watch a worker covertly at a workplace, solely to find out whether the worker is engaged in unlawful activity there. The application gives particulars of: the grounds for suspicion and the worker's name if practicable; any steps the employer took to detect the activity and their result; the workers usually to be watched, named or described as a group or class; the site, computer, vehicle or other object to be watched; the kind of device; the proposed period; any earlier application for the same surveillance, its result and any surveillance done under it; and anything the regulations prescribe. It nominates at least one surveillance supervisor. After a refusal, a further application for the same surveillance needs additional relevant information.
