Every residential tenancy agreement contains the Schedule 1 standard residential tenancy terms (and the Schedule 2 clauses that apply to the lessor type or that the parties agree, such as the posting clauses), and may add only terms consistent with them. A term inconsistent with a standard term is void unless both parties applied to ACAT and ACAT endorsed it, and a term inconsistent with the Act itself can never be endorsed. Additional clauses must not modify existing clauses and neither party can contract out of the agreement or the Act.
