ACT Residential Tenancies Act 1997 s66-70: ss 66, 69 to 71AAA Rent frozen on review, refunds and reduction orders

While a tenant's review of an increase is pending no increase takes effect unless ACAT allows it; after ACAT has reviewed a proposed increase, any further increase within 12 months of the proposed date is void. Where ACAT disallows an increase the tenant has paid, the lessor may be ordered to refund the difference. Where a rent reduction order is in force (for withdrawn services, disrepair, lost security, loss of use, interference with quiet enjoyment, or failure to meet a minimum housing standard), any purported increase is void and any excess paid is a debt the lessor owes the tenant.
