ACT Residential Tenancies Act 1997 s64B-cl38-41: s 64B, Regulation s 5A, Sch 1 cls 38 to 41 Rent increase notice and the CPI-based threshold

The lessor must give the tenant at least 8 weeks' written notice of a proposed increase (including one to take effect under a proposed consecutive agreement), stating the date it takes effect, the amount, whether it exceeds the prescribed amount, and that an increase above the prescribed amount needs ACAT's prior approval if the tenant does not agree in writing. The prescribed amount is 110 percent of the change in the rents component of the Canberra CPI between the initial and current index numbers, applied to the current rent. An increase above it is lawful only with the tenant's written agreement after the notice, ACAT's prior approval, or for a pre-amendment fixed term agreement that allows it. A tenant may seek review at least 2 weeks before the effective date, and no increase is payable while a review is undecided.
