Rent may not vary except as the Act allows. A lessor must not increase the rental rate unless the increase takes effect at least 12 months after the agreement started (first increase) or after the last increase took effect; for a consecutive agreement the 12 months run from the last increase under either agreement. The frequency and amount limits apply while at least one tenant remains the same as at the last increase. A fixed term agreement signed before the 2024 amendment commenced may be increased during the term only if the agreement sets the amount or method. The housing commissioner follows its own review cycle with the same 12-month floor.
