Western Australia Fair Trading Act 2010
Parts 5 and 6: The Commissioner, investigation and enforcement powers – Western Australia Fair Trading Act 2010

Western Australia Fair Trading Act 2010 88A-88E: Regulated persons: admit compliance checks at business premises during business hours without a warrant

What does 88A-88E require?

Where a person holds an authorisation (a licence, registration or similar) under one of the registration Acts the Commissioner administers, an authorised person may enter the premises where that regulated person's business is carried on during normal business hours without a warrant, and once inside may require information, answers and documents, seize things and use the information, to check compliance with the conditions of the authorisation, with the registration Act, or with a code of conduct under that Act. The check may be made even if no investigation is under way, and police may assist. The power does not reach activity regulated by the Charitable Collections Act 1946, nor short-term rental activity regulated under the 2024 Act for that sector.
