Western Australia Fair Trading Act 2010
Parts 5 and 6: The Commissioner, investigation and enforcement powers – Western Australia Fair Trading Act 2010

Western Australia Fair Trading Act 2010 69-88: Give truthful information, answers and documents when an authorised person requires them in an investigation

What does 69-88 require?

When investigating under this Act or under another Act the Commissioner administers, authorised persons can demand that anyone give information, answer questions and produce documents or things, orally or by written notice stating a time for compliance, and may copy what is produced. It is an offence, absent a reasonable excuse, to miss the time set for the information or answer, to give an answer or information that is materially false or misleading, or to fail to produce the document or thing. Defences apply where the requirement did not state it was made under the Act, the time allowed was insufficient, or the authorised person lacked reasonable grounds.
