WA health entities must ensure that AI requirements for vendors are specified in writing when contracting for ICT, digital health systems and medical technology. The contract must require the vendor to declare the nature of any AI in the products and services supplied, to notify the contract manager whenever a new or updated AI-based feature is released in a product it supplies, to allow the customer to opt out of AI features, and to provide assurance of ongoing adherence to the entity's requirements, in particular any AI specifications provided during procurement (Health Support Services can supply a standard set of non-functional requirements), digital security under MP 0067/17 Information Security Policy and information governance under MP 0015/16 Information Access, Use and Disclosure Policy. Liabilities and indemnities must be clarified, with particular attention to any proposed departure from standard terms and conditions.
