Victoria Owners Corporations Act 2006 159A-169J: Short-stay accommodation complaints and VCAT orders

What does 159A-169J require?

A separate complaints and VCAT path (inserted by Act No. 34/2018 as Divisions 1A and 2A of Part 11) applies to short-stay accommodation: complaints about unreasonable noise, hazards, damage or obstruction by short-stay occupants follow sections 159A to 159F (decision, notice to rectify, final notice, report to the AGM), and VCAT may make prohibition orders, loss of amenity compensation orders up to the capped amount and civil penalties against short-stay occupants, with the short-stay provider and occupant jointly and severally liable (sections 169A to 169H). Section 169I and 169J allow a lot owner to be authorised to pursue proceedings in the owners corporation's name.
