Victoria Occupational Health and Safety Regulations 2017 r20: r 20 Keep health monitoring reports confidential and release copies only as permitted

Reports from medical examinations or health monitoring required by the Regulations, and any summaries of them, must be kept confidential by the employer. The employer must give a copy: to the person concerned, as soon as reasonably possible once the employer has it; to a third party the person has authorised in writing; and to WorkSafe when it asks or when the Regulations require it. Penalty: 100 penalty units (natural person) or 500 (body corporate). Under section 69 of the Act an HSR may see de-identified medical information, and identifying information only with the employee's consent.
