When a governmental entity's subpoena or court order under s. 2703(b)(2) requires it, the provider must, without notifying the subscriber or customer, create a backup copy of the communications sought as soon as practicable consistent with its regular business practices and within two business days of receipt, confirm to the entity that the copy exists, not destroy it until the later of delivery of the information and the resolution of any proceedings on the subpoena or order, and release it no sooner than 14 days after the entity's notice to the customer unless the customer has challenged the request.
