A recipient found by the Director to have discriminated must take the remedial action the Director deems necessary to overcome its effects, including for people who left or were deterred from the program; a controlling recipient may be required to act too. Every recipient must evaluate, with the assistance of interested persons including people with disabilities or their organisations, its current policies and practices and their effects that do not or may not meet Part 84, modify those that do not, and take remedial steps to eliminate the effects of past adherence to them; the self-evaluation was due within one year of the effective date of the rule (the 2024 revisions carry their own date) and a recipient with fifteen or more employees must keep on file for three years, make available for public inspection and supply on request a list of the persons consulted, the areas examined and problems found, and the modifications and remedial steps taken.
