US Section 504 of the Rehabilitation Act (29 USC 794) and HHS Rule 45 CFR Part 84 84.5: Submit a section 504 assurance with each application for HHS assistance, and carry the nondiscrimination covenant on assisted real property

What does 84.5 require?

An applicant for HHS Federal financial assistance must submit an assurance, on the form the Director of the Office for Civil Rights specifies, that the program or activity will be operated in compliance with Part 84 (which may be incorporated by reference in later applications). The assurance binds the recipient, and any transferee, for as long as real property or structures acquired with the assistance are used for the assisted purpose or a similar purpose, for as long as personal property is owned or possessed, and otherwise for the period of assistance. Where HHS transfers real property, or property is bought or improved with assistance, the instrument of transfer must carry a covenant running with the land to assure nondiscrimination, with a right of reverter reserved to the Department.
