US Section 504 of the Rehabilitation Act (29 USC 794) and HHS Rule 45 CFR Part 84 84.55: Treatment of infants with disabilities: ensure that nourishment and medically beneficial treatment are not withheld on the basis of present or anticipated impairment (Infant Care Review Committees encouraged)

What does 84.55 require?

Section 504 applies to health care for infants with disabilities: medically beneficial treatment and nourishment may not be withheld from an infant solely on the basis of present or anticipated physical or mental impairments where the infant will benefit medically. The Department encourages, but does not require, each recipient health care provider serving infants to establish an Infant Care Review Committee of at least seven members (a practicing physician, a nurse, an administrator, a lawyer, a disability representative or developmental disability expert, a lay member and a medical staff chair) to recommend institutional policies on withholding or withdrawing life-sustaining treatment, advise on specific cases with a special advocate for the infant, review such cases retrospectively, and keep records and communicate its existence to staff and families; HHS consults an ICRC run substantially on the model when assessing compliance.
