In providing health, welfare or other social services a recipient may not, on the basis of disability, deny a qualified person benefits or services, offer an unequal opportunity, provide benefits that are not as effective, deliver them in a way that limits participation, or provide different or separate benefits except where necessary to make them as effective; notices about benefits and written material on waivers of rights or consent to treatment must be given so that persons with impaired sensory or speaking skills receive effective notice. A recipient operating a health care facility may not discriminate in admission or treatment against a person with a substance or alcohol use disorder who has a medical condition because of that disorder. A recipient serving persons institutionalised because of disability must ensure each qualified individual is provided an appropriate education consistent with the Department of Education's 34 CFR 104.33(b).
