A postsecondary recipient may not deny admission or discriminate in admission or recruitment on the basis of disability; may not limit the number or proportion of persons with disabilities admitted; may not use any admission test or criterion with a disproportionate adverse effect on persons with disabilities unless it is validated as a predictor of success and no less adverse alternative is shown to be available (with periodic validity studies against overall success); must ensure that admissions tests given to applicants with sensory, manual or speaking impairments measure aptitude rather than the impairment, that adapted tests are offered as often and as timely as others, and that tests are administered in accessible facilities; and may not make preadmission inquiry into disability except on a voluntary, confidential basis for remedial or voluntary action, although confidential inquiries about needed accommodations may follow admission.
