The 7(a) Lender obtains all required collateral and meets all other conditions in the Terms and Conditions and credit memorandum (equity injections, standby agreements, appraisals) before or at disbursement, obtains a valid, enforceable security interest with evidence of the required lien priority, and keeps proof of filing and of recordation (it may sell after filing but bears a denial for losses from an unperfected lien). It obtains evidence of every licence needed to operate within 90 days after final disbursement and does not sell the loan before then. Under the Debt Collection Improvement Act it reports the loan to credit reporting agencies and continues to report servicing, liquidation and charge-off activity.
