An SBA Lender that uses electronic signatures ensures they meet NIST Digital Identity Guidelines Identity Assurance Level 2, the federal legally binding e-signature requirements and the ESIGN definition (never voice or audio only), uses them only where the recording office accepts them and jurisdictions allow electronic filing, and complies with UCC Articles 9-105 and 3 for electronic chattel paper and notes. Its vendor complies with ESIGN section 101, has the capability and expected longevity, contractually commits to SBA requirements and to testify for the government, meets disaster recovery and archiving needs and has quality control; the Lender oversees the process through its own policies and keeps the audit trail, systems and documentation available to SBA for the retention period, able to reproduce records accurately.
