US Occupational Safety and Health Act of 1970 6d: Permanent variance: apply where the employer's own methods are as safe as the standard

What does 6d require?

An employer affected by a standard can ask the Secretary, by rule or order, for a permanent variance from a standard. Affected employees must be notified of the application and given a chance to take part in a hearing. The Secretary grants the variance on finding, by a preponderance of evidence after any inspection and the hearing, that the employer's own methods, practices, operations, processes and conditions give employees a place of employment as safe and healthful as the standard would; the order states the conditions the employer must keep and may be modified or revoked on application or on the Secretary's own motion after six months.
