US Occupational Safety and Health Act of 1970 6b6: Temporary variance: apply where compliance by the effective date is not possible

What does 6b6 require?

An employer that cannot meet a standard's effective date because the professional or technical staff, materials or equipment it needs are unavailable, or because necessary construction or alteration cannot be completed in time, may seek from the Secretary a temporary variance order. The application must show that the employer is taking all available steps to protect employees from the hazard and has an effective programme for coming into compliance as quickly as practicable, state the dates and the measures taken, and certify that employees have been told of the application, that a copy was given to their authorised representative and that a summary was posted. A temporary order lasts no longer than needed to reach compliance or one year, renewable at most twice.
