Retention, inspection, copying, electronic systems, security and electronic signatures (8 CFR 274a.2(b)(2) to (b)(4) and (e) to (i)) – US Form I-9 Employment Eligibility Verification (8 USC 1324a and 8 CFR Part 274a)

US Form I-9 Employment Eligibility Verification (8 USC 1324a and 8 CFR Part 274a) 274a.2(b)(3)-(4): If you copy documents, copy them for everyone, keep the copies with the form or retrievable with the employee's records, and use the form and copies only for immigration and related enforcement

What does 274a.2(b)(3)-(4) require?

An employer, recruiter or referrer may, but need not, copy or make an electronic image of documents presented, solely to comply with verification; copies must be retained with the Form I-9 or stored with the employee's records and be retrievable under the electronic standards, and copying does not relieve the employer of fully completing Section 2. Copying only the documents of individuals of certain national origins or citizenship statuses may violate section 274B. Information in or appended to the form, including document copies, may be used only for enforcement of the Immigration and Nationality Act and the Federal false statement, identity document, visa fraud and false claim to citizenship offences, never for other personnel purposes; E-Verify employers must retain copies of the List A documents the program specifies.
