A paper form with original handwritten signatures, a compliant electronic form, an original scanned into electronic format, a combination meeting the electronic standards, or a microfilm or microfiche copy of the original signed version must be retained by the employer for three years after the date of hire or one year after the date employment is terminated, whichever is later; a recruiter or referrer for a fee retains for three years after the hire. For a rehire the period runs from the original execution date or one year after the later termination. Forms I-9 are not required for employees hired before 7 November 1986 who have continued in employment.
