An employer, recruiter or referrer must be given at least three business days' notice before officers of DHS, the Immigrant and Employee Rights Section or the Department of Labor inspect its Forms I-9; at inspection the forms must be made available in original paper, electronic form, a paper copy of the electronic form, or microfilm or microfiche at the location where the request was made, or the employer must disclose where they are kept and arrange the inspection, which may occur at an agency office. No subpoena or warrant is required, and refusal or delay is a retention violation; forms not produced may be compelled by subpoena. Microform must be legible and readable with a detailed index permitting immediate location of any record, with a clean, working reader-printer able to display and print a complete page supplied at the examination site; failure to meet the microform standards while not presenting a completed form is a verification violation.
