A driver convicted of a major offence (driving a CMV under the influence of alcohol at 0.04 or more, or any vehicle under the influence, refusal to test, leaving the scene of an accident, using a vehicle to commit a felony, driving a CMV with a revoked CDL, negligent homicide in a CMV) is disqualified for one year (three years if transporting hazmat) for a first offence and for life for a second, with lifetime disqualification for using a CMV in felony drug trafficking or human trafficking. Two serious traffic violations (excessive speeding 15 mph or more over, reckless driving, improper lane change, following too closely, texting, hand-held phone use, driving without a CDL in possession or without the proper class or endorsement) within three years bring a 60-day disqualification and three bring 120 days. Railroad-highway grade crossing offences bring 60 days to one year and out-of-service order violations bring 180 days to five years. The employer must not use a disqualified driver and must check the driving record.
