Every manufacturer (including importer), distributor and retailer that obtains information reasonably supporting the conclusion that a product fails to comply with an applicable rule or relied-upon voluntary standard, fails to comply with any other rule or ban the Commission enforces, contains a defect that could create a substantial product hazard, or creates an unreasonable risk of serious injury or death must report immediately, meaning within 24 hours, unless it knows the Commission is adequately informed. Firms need not wait for complete risk estimates; an investigation to evaluate reportability should normally take no more than 10 days, and knowledge is imputed once information reaches an employee capable of appreciating it (at most 5 days to reach the responsible official).
