A public entity not in full compliance with 35.200(b) is deemed to meet 35.200 only in the limited circumstance where it can demonstrate that the nonconformance has so minimal an impact on access that it would not affect the ability of individuals with disabilities to use the web content or mobile app to access the same information, engage in the same interactions, conduct the same transactions and otherwise participate in or benefit from the same services, programs and activities as individuals without disabilities, with substantially equivalent timeliness, privacy, independence and ease of use.
