Beginning 26 April 2028, a public entity with a total population of less than 50,000, or any public entity that is a special district government, ensures that its web content and mobile apps, provided directly or through contractual, licensing or other arrangements, comply with the Level A and Level AA success criteria and conformance requirements of WCAG 2.1, subject to the same fundamental alteration and undue burdens limit. The date was 26 April 2027 in the 2024 rule and was extended by the Interim Final Rule of 20 April 2026. A special district government (35.104) is a public entity other than a county, municipality, township or independent school district, authorized by State law to provide one or a limited number of functions with enough administrative and fiscal autonomy to be a separate government and without its own Census population figure.
