Beginning 26 April 2027, a public entity other than a special district government with a total population of 50,000 or more ensures that the web content and mobile apps it provides or makes available, directly or through contractual, licensing or other arrangements, comply with the Level A and Level AA success criteria and conformance requirements of WCAG 2.1 (W3C Recommendation of 5 June 2018, incorporated by reference), unless it can demonstrate that compliance would result in a fundamental alteration of a service, program or activity or in undue financial and administrative burdens (see 35.204). The date was 24 April 2026 in the 2024 rule and was extended by the Interim Final Rule of 20 April 2026. Total population is the decennial Census figure for the entity, or for independent school districts the Small Area Income and Poverty Estimate, or for instrumentalities and commuter authorities the combined figure of the governments they serve.
