US 2010 ADA Standards for Accessible Design 36.406: Title III: standards election by permit date, and the lodging, housing, assembly and medical provisions

What does 36.406 require?

The standard for new construction and alterations follows the date the last building permit application was certified complete or received (or the start of physical work where no permit is needed): the 1991 Standards before 15 September 2010; either the 1991 or 2010 Standards from 15 September 2010 to 14 March 2012; and the 2010 Standards from 15 March 2012, with ceremonial groundbreaking and demolition not counting as a start. Non-compliant pre-2012 work must be made accessible under the 1991 or 2010 Standards. The section also applies the Standards' transient lodging provisions to places of lodging including timeshares and condominium hotels (with ownership and rental program conditions), the residential facilities provisions to housing at places of education and to social service centre establishments with sleeping accommodation, requires dispersion of accessible seating in assembly areas and specialty seating, and applies the medical care provisions with dispersion among categories of care.
