US 2010 ADA Standards for Accessible Design 36.404-405: Title III alterations: elevator exemption and historic preservation

What does 36.404-405 require?

An altered private building below three storeys, or below 3,000 square feet per storey, need not add an elevator, unless it is a shopping centre or mall, a health care provider's professional office, a transit terminal, depot or station, or an airport passenger terminal; the exemption never relieves the owner of making the altered areas and the route to them accessible by other means. Alterations to qualified historic buildings follow the Standards' historic provisions as far as feasible, and where physical access would damage the historic significance, other means of access must be offered.
