United States CAN-SPAM Act of 2003 and FTC CAN-SPAM Rule (16 CFR Part 316) 7705: s 7705 Businesses promoted in email: take reasonable action against messages with false header information

A business must not promote, or allow promotion of, its goods or services in commercial email sent with materially false or misleading header information where it knew or should have known of the promotion, received or expected an economic benefit, and took no reasonable action to prevent the transmission or to detect and report it to the FTC. This makes advertisers answerable for affiliates and lead generators.
