Traffic data about subscribers or users processed and stored by a public communications provider must be erased, or modified so it is no longer personal data (for a corporate subscriber, so it would not be personal data were the subscriber an individual), once it is no longer needed to transmit a communication. It may be kept for billing and interconnection payments until the period for bringing legal proceedings on the payments ends or any proceedings are finally determined, including appeal periods. A service provider may process traffic data to market electronic communications services or provide value added services only with the prior consent of the subscriber or user concerned and only for as long as needed, and that consent can be withdrawn at any time.
