A relevant public communications provider (a public mobile network operator holding a wireless telegraphy licence) may disregard the traffic and location data restrictions to provide an emergency alert service only when notified by a relevant public authority of an emergency and directed to send a specified message over a specified period to users in, or recently in, the affected places, and when it complies with that direction; or to test the service on a Minister's direction. Traffic or location data processed this way must be erased or anonymised within 7 days after the alert period ends, or within 48 hours of receiving the Minister's test directions, and processed only by the provider or under its authority.
