Part 3 Chapter 3: duties of care for search services – UK Online Safety Act 2023

UK Online Safety Act 2023 s.26: Illegal content risk assessment (search)

What does s.26 require?

Search services carry out, keep current and repeat before significant changes a suitable and sufficient assessment of the risk of users encountering each kind of priority illegal content and other illegal content in search results, considering algorithms and how results are indexed, organised and presented, higher-risk functionalities, the nature and severity of harm, and how design and operation affect risk. Category 2A services summarise the findings in a publicly available statement (s.27(9)). In force: risk assessment duties from 16 December 2024 (first assessments due by 16 March 2025); safety duties from 17 March 2025, when the first illegal content codes took effect (s.51).
