Truth in Lending Act (TILA) 1026.35-escrow: Higher-priced mortgage loans: mandatory escrow for taxes and insurance

A creditor may not extend a higher-priced mortgage loan secured by a first lien on the consumer's principal dwelling unless an escrow account for property taxes and required insurance premiums is established before consummation, subject to the exemptions the rule lists (for example certain small creditors in rural or underserved areas); a higher-priced mortgage loan is one whose APR exceeds the average prime offer rate by 1.5 points or more for a first lien (2.5 points for a jumbo loan, 3.5 for a subordinate lien) (12 CFR 1026.35(a)-(b)).
