For a high-cost mortgage, a creditor may not pay a home-improvement contractor from loan proceeds except by an instrument payable to the consumer or through a conditioned escrow arrangement, must give notice to any assignee, may not recommend or encourage default on an existing loan to be refinanced, may not charge a prepayment penalty, may not finance points and fees into the loan beyond the limits set, and must not make the loan without regard to the consumer's ability to repay (12 CFR 1026.34).
