Access, caching, hosting and link providers are protected from civil and criminal liability only if they meet the conditions: access providers do not initiate, select receivers or modify transmissions; caching providers do not modify data, respect access conditions and industry update rules, and remove data once removed at source or ordered by a court; hosting and link providers remove or disable data or links promptly after a court order, notify Tonga Police of data they reasonably believe unlawful (link providers also remove the link), and remove intellectual property infringements once aware. There is no general monitoring obligation, and good-faith removal carries no liability to users.
