Taiwan PDPA A8: Article 8 and ER 16: Notice when collecting from the data subject

What does A8 require?

When collecting directly, the agency must clearly tell the person its name, the purpose, the data categories, the period, area, recipients and method of use, the rights under Article 3 and how to exercise them, and the effect of not providing data where provision is optional; exemptions cover statutory exemption, statutory duties or obligations, obstruction of official duties or the public interest, the person already knowing, and non-profit collection clearly not detrimental to them. Notice may be given orally, in writing, by phone, text, email, fax, electronic document or any other means that lets the person know (ER 16).
