Part 2: access to records of public bodies – South Africa Promotion of Access to Information Act (PAIA)

South Africa Promotion of Access to Information Act (PAIA) s28-31: ss.28 to 31 Sever refusable parts, give access in the requested form and language, and accommodate disability

What does s28-31 require?

Every reasonably severable part of a record that contains no refusable information must be disclosed. Once fees are paid, access must be given in the requested form (copy, inspection, viewing or hearing, transcription, printout or computer-readable copy) unless that would unreasonably interfere with administration, harm the record or infringe copyright not owned by the State, without charging more than the requested form would cost; in the preferred language where the record exists in it; and, for a requester with a disability, in a usable form at no extra cost. Before releasing a health record that might seriously harm the person, the officer may consult a health practitioner nominated by that person and release only with adequate counselling arrangements.
