Part 2: access to records of public bodies – South Africa Promotion of Access to Information Act (PAIA)

South Africa Promotion of Access to Information Act (PAIA) s18-20: ss.18 to 20; reg. 7 Accept requests, assist requesters and transfer misdirected requests within 14 days

What does s18-20 require?

Requests to a public body are made on Form 2 to the information officer's address, fax or email; an individual unable to write because of illiteracy or disability may request orally and the officer must reduce it to the prescribed form and give the requester a copy. The information officer must give free, reasonable assistance, may not refuse a non-compliant request without first giving notice with reasons and an offer of help and a chance to fix it, and must, within 14 days, transfer a request for a record held by, more closely connected with, or of greater commercial interest to, another public body (or help the requester redirect it), notifying the requester of the transfer, reasons and deadline.
