South Africa Occupational Health and Safety Act 85 of 1993
Sections 17 to 20: Health and safety representatives and committees – South Africa Occupational Health and Safety Act 85 of 1993

South Africa Occupational Health and Safety Act 85 of 1993 20: Functions of committees: recommendations to the employer or an inspector on any health or safety matter, discussion of every incident causing injury, illness or death with a written report to an inspector where chosen, prescribed functions, records of recommendations and reports, and the employer's duty to take prescribed steps so the committee meets and performs

What does 20 require?

A health and safety committee may make recommendations to the employer on anything bearing on the health or safety of people at the workplace or section it serves and, if those recommendations do not settle the matter, to an inspector; it discusses every workplace incident that injured, sickened or killed someone and may send an inspector a written report on it; and it performs any further prescribed functions. The committee records every recommendation it makes to the employer and every report it sends an inspector, its members incur no civil liability merely for omitting to act, and the employer takes the prescribed steps to ensure the committee meets as section 19(4) requires and performs these duties.
