South Africa Occupational Health and Safety Act 85 of 1993
Sections 17 to 20: Health and safety representatives and committees – South Africa Occupational Health and Safety Act 85 of 1993

South Africa Occupational Health and Safety Act 85 of 1993 17: Health and safety representatives: designated in writing within four months wherever more than 20 employees work at a workplace, after good-faith consultation on nomination, election and term, from full-time employees acquainted with the workplace, at least one per 100 employees in shops and offices and one per 50 elsewhere, more if an inspector directs, with their activities in working hours

What does 17 require?

Every employer with more than 20 employees at a workplace designates in writing, for a specified period and within four months of the Act, of starting business or of exceeding 20 employees, health and safety representatives for the workplace or its sections. The employer consults in good faith with recognised employee representatives, or with the employees, on the arrangements for nomination or election, period of office and designation, with arbitration if consultation fails. Only full-time employees acquainted with the conditions and activities of the workplace or section are eligible. The number is at least one representative per 100 employees or part thereof in shops and offices and one per 50 or part thereof in all other workplaces (employees working away from their reporting workplace counted where they report), and an inspector may direct a higher number, including for workplaces of 20 or fewer. Designation, functions and training take place in ordinary working hours and count as time worked.
