South Africa National Health Insurance Act 20 of 2023 39-6: Performance monitoring, five-yearly renewal and the grounds for withdrawal of accreditation

What does 39-6 require?

An accredited provider's or establishment's performance is monitored and evaluated under the Act and the contract, with sanctions applied for deviation from contractual obligations (section 39(6)); accreditation is renewed every five years on compliance with the section 39(2) criteria (section 39(7)); and the Fund can cancel accreditation, or decline to renew it, where it is proven that the provider or establishment cannot or did not deliver the required comprehensive benefits, no longer holds or cannot produce OHSC certification, or otherwise fails the accreditation criteria, after notice and an opportunity to make representations under section 42(4) (section 39(8)). The Fund also monitors providers' registration, licence and accreditation status continuously (section 10(1)(l)).
