South Africa Competition Act 89 of 1998
Chapter 2 Parts B and C and Chapter 2A: abuse of dominance, price discrimination and exemptions – South Africa Competition Act 89 of 1998

South Africa Competition Act 89 of 1998 8-4: Dominant firms in designated sectors: no unfair prices or trading conditions imposed on SME and HDP suppliers

What does 8-4 require?

Since 13 February 2020, a dominant firm in a sector the Minister designates by regulation must not, directly or through others, demand or impose unfair prices or unfair trading conditions on a supplier that is an SME or an HDP-controlled firm (one that historically disadvantaged persons own or control), and must not stop or refuse buying from such a supplier to get around that rule (section 8(4)). Once a prima facie case exists, the burden shifts to the dominant firm to show the price or condition is not unfair, or that its refusal to buy was not a circumvention. The Minister's regulations designate the sectors, the benchmarks for identifying HDP-controlled firms and the factors for judging unfairness (the Buyer Power Regulations).
