South Africa Competition Act 89 of 1998
Chapter 2 Parts B and C and Chapter 2A: abuse of dominance, price discrimination and exemptions – South Africa Competition Act 89 of 1998

South Africa Competition Act 89 of 1998 8-1b: Dominant firms: access to essential facilities when economically feasible

What does 8-1b require?

A dominant firm must not deny a competitor the use of an essential facility (infrastructure or a resource that rivals cannot reasonably duplicate and without which they cannot reasonably serve their customers) when giving access is economically feasible (section 8(1)(b)). Owners of ports, pipelines, networks, terminals and comparable bottleneck assets need a defensible, non-discriminatory access regime.
