South Africa Competition Act 89 of 1998 10: Exemptions: apply on the statutory grounds, give accurate information and honour conditions

What does 10 require?

A firm may apply to the Commission to exempt an agreement, practice or category of them from Chapter 2 where the restriction is required to attain, and the arrangement contributes to, maintenance or promotion of exports, effective entry, participation or expansion by SMEs or HDP-controlled firms, a change in productive capacity needed to stop decline in an industry, the growth, development, transformation or stability of an industry the Minister designates, or efficiency and competitiveness gains that support jobs or industrial expansion (section 10(3)); intellectual property arrangements may be exempted under section 10(4). Exemptions are granted for a specified term, may carry conditions, are published in the Gazette after 20 business days for representations, and may be revoked if granted on false or incorrect information, a condition is not fulfilled or the reason no longer exists (section 10(5)). Schedule 1 governs exemption of professional rules, and the Minister may exempt categories of agreements by regulation (section 10(10)).
