South Africa Competition Act 89 of 1998
Chapter 3: merger control – South Africa Competition Act 89 of 1998

South Africa Competition Act 89 of 1998 13B-15: Merger parties: supply the information the Commission requires, keep it accurate and honour approval conditions

What does 13B-15 require?

The Commission can demand further information from any merger party and can direct an inspector to investigate the merger (section 13B). The Commission may revoke its approval or conditional approval of a small or intermediate merger, and revisit any condition, if the decision rested on incorrect information for which a merger party is responsible, the approval was procured by deceit, or a firm has broken an obligation the decision imposed, and may then prohibit the merger despite expired time limits (section 15). Public interest conditions (employment moratoria, local procurement, supplier development, ownership commitments) are enforced through this route and through section 59(1)(d)(iii).
