A transfer of control of a service provider needs the Regulator's prior written approval where a dominant provider or its affiliate is the acquirer or the entity transferred, or where the acquirer and affiliates would reach 40 percent or more of gross revenues in a market; without approval the transfer has no legal effect. The application must identify all persons involved and anyone with more than 5 percent ownership in them, describe the transaction and its commercial terms, give financial information including revenues by market, assets and recent financial reports, and describe the markets; the Regulator may ask for more and decides within 90 days (31).
