Chapter III: Rights of the data subject – Rwanda DPL

Rwanda DPL 25-26: Heirs to personal data and representation of the data subject

Personal data are not subject to succession, but where the data subject left a will giving an heir full or restricted rights over the processing of personal data kept by the controller or processor, those rights apply if the data still need to be used (25); the rights of a data subject under sixteen are exercised by the holder of parental authority or guardian, of a data subject with a physical or medically determinable mental impairment by a parent, adopter, caring centre or association or court-appointed guardian, and otherwise by a person authorised in writing by the data subject (26); the controller's rights procedures must recognise and verify these representatives.
